TERMS & CONDITIONS FOR APPLYING FOR THE TASTE MASTER S2 2021

1. Introduction

1.1 The Taste Master (“The Taste Master/Programme”) is a 13 (thirteen) episode weekly reality competition television series that is scheduled to broadcast on SABC 2 every Friday between 19h00 and 20h00 from 10 September 2021 to 3 December 2021.

1.2 The Taste Master will include a competition (“Competition”) where selected contenders (“Contenders”) will compete in various challenges during the period between 16 August 2021 and 3 December 2021 (“Competition Period”), that will be televised as part and parcel of The Taste Master.

1.3 The Taste Master and the Competition will be produced and conducted by Cardova Trading (Pty) Ltd (“Producers”).

1.4 The Taste Master is sponsored by Mondeléz South Africa (Pty) Ltd (“Mondeléz”), Woolworths (Pty) Ltd, Samsung Electronics SA (Pty) Ltd, Swiss Diversitas Group (Pty) Ltd and Le Creuset South Africa (Pty) Ltd (collectively “the Sponsors”).

1.5 The winner of the Competition will receive prizes to the total approximate value of R50 000 (fifty thousand rand) as more fully detailed in clause 6 below.

1.6 By submitting your application for The Taste Master, you accept and agree that the terms and conditions as set our herein are binding on you. A copy of these terms and conditions will be available on www.thetastemaster.co.za.

2. Who can apply

2.1 In order to be considered as a Contender for the Competition, you must: –

2.1.1 have a passion for food;

2.1.2 be a permanent legal resident of the Republic of South Africa (“South Africa”);

2.1.3 be 18 (eighteen) years of age or older;

2.1.4 ensure that, if selected as a Contender, you can be fully available to participate in the Competition on any dates and times as may be required by the Producers during the Competition Period;

2.1.5 Not be a director, member, partner, employee, agent or consultant of the Producers, the SABC, any of the Sponsors, or any of their holding companies or subsidiaries (collectively “Stakeholders”).

3. How to apply

3.1 Applications for Contenders will be received via www.thetastemaster.co.za between 14 June 2021 and 13 August 2021 (“Application Period”). Notwithstanding the aforesaid, the Application Period may be amended by the Producers at its discretion without further notice. 

3.2 To apply, you must record a video of yourself, telling us who you and show us you baking a dish using Royal Baking Powder products. Then visit www.thetastemaster.co.za to complete the entry form and upload your video within the Application Period (“Application”). You must follow all the directions for entry that will be provided on www.thetastemaster.co.za.

4. How Contenders will be selected and Auditions

4.1  The Producers will in their sole discretion select a shortlist of applicants who will be invited for auditions via an online platform on such dates and times determined by the Producers. The Producers may at any time at its sole discretion cancel or withdraw an invitation that was sent to an applicant.

4.2  Applicants who are invited for auditions (“Invited Applicants”), will be responsible for own arrangements and or costs (if any) to participate in the online auditions.

4.3  If an Invited Applicant is for any reason unable to attend the audition, he/she will not be considered as a contender and shall have no claim against the Stakeholders.

4.4 The Producers will at their sole and unfettered discretion select the Contenders from the Invited Applicants, who will be invited to participate in the Competition. Participation in the Competition will be subject to the selected person entering into and signing a written Participation Agreement that will be provided by the Producers.

5.  The Competition overview and determination of the Winner

5.1 The Competition will be conducted and filmed at various locations within South Africa during the Competition Period (mainly Cape Town).

5.2  The Producers will provide for reasonable transportation, accommodation and subsistence for the Contender to participate in The Taste Master and the Competition on dates required by the Producers.

5.3 Contenders will be eliminated throughout the Competition Period.

5.4 The winner of the Competition (“Winner”) will be determined at the sole and unfettered discretion of the Producers, or its appointed representatives (e.g. Judges) and will be announced during the broadcast of the final episode of The Taste Master on 3 December 2021 (unless otherwise determined by the Producers).

6. Prizes

6.1 The Winner will receive a prize to the total approximate value of R50 000 (fifty thousand rand) including vat, the content of which will be determined and announced by the Producers at its discretion.

7. By submitting your Application, you acknowledge/agree/submit that: –

7.1 If selected as a Contender herein, you will be available to participate in the Competition, without restriction, for the full duration of the Competition Period on such dates and times determined by the Producers.

7.2 You are 18 (eighteen) years of age or older.

7.3 You are a permanent legal resident of South Africa and you will produce your valid South African ID, or other valid ID with the necessary visas/permits that allows you to live and work without restrictions in South Africa, if and when requested to do so.

7.4 All the information included on your Application is true.

7.5 You are not, and shall not at any stage during the Competition be, a member, director or employee of any of the Stakeholders.

7.6 You have no contractual or other legal obligations that may conflict with your Application or participation in The Taste Master and or the Competition.

7.7 The Contenders, eliminations throughout the Competition and the Winner of the Competition, will be determined in the sole and unfettered discretion of the Producer, and/or its appointed representatives (e.g. the Judges). You irrevocably accept and agree that the Producer’s and/or the Judges’ decisions regarding the aforesaid will be final and you will not challenge same.

7.8 The Taste Master is sponsored by the Sponsors and, if selected as a Contender, you agree to make use of Sponsor products as and when required throughout the Competition.

7.9 If selected as Contender, you shall not engage in any activities that violate any law, offend against public morals or that reflects negatively on the Programme, or the Stakeholders, compromise the success of the Programme and the Sponsors’ marketing activities related to the Programme, or embarrass the Stakeholders in any way.

7.10 You agree that the Producers may use your personal information submitted on your Application, or at any time thereafter to conduct such background checks that may be deemed necessary in their discretion to confirm that you are a suitable candidate to participate in the Competition.

7.11 You acknowledge that the Competition and related activities (e.g. Applications/behind the scenes/profile shoots) may be televised as part and parcel of the Programme and/or as otherwise distributed by the Producers. You hereby irrevocably assign to the Producer the entire copyright and all other rights of whatsoever nature in and to your participation in and your contribution to the Programme, whether now in existence or arising in the future, including without limitation, the video material submitted on your Application, your performance and/or any comments ascribed to you (whether as part of an interview and/or behind the scenes footage), during Auditions, profile shoots, during your participation in the Competition and/or the Programme and any inclusion of your photographs, likeness, profile, name, voice, sound effect, caricature, literary, artistic and musical materials and the like for purposes of the Programme and/or any related publicity, research and marketing, which the Producers accept. The Producers shall therefore be entitled to use, edit, juxtapose, broadcast, re-broadcast, publish or communicate to the public your appearance/performance/participation and exploit and license others to use and exploit such contributions, in the whole or in part, by all means and by all media, manner and formats whether now known or hereafter invented throughout the world and in perpetuity without remuneration or royalties in connection with the Programmes or on its own.

7.12 You hereby waive all worldwide moral rights, performers’ rights or similar rights (as defined under the Copyright Act 98 of 1978, the Performers’ Protection Act 11 of 1967 or in terms of any similar laws of any other jurisdiction) which you may have in your performance/participation.

7.13 Should the Producer decide not to proceed with The Taste Master, for any reason whatsoever, the Producer may in its sole discretion elect to terminate this Application without any liability to you.

7.14 Contenders will be required to maintain a Twitter, Facebook and Instagram account during the Competition Period and during the initial broadcast of the Programme on SABC 2. Contenders will be required to post weekly posts on their Social Media platforms to promote the Programmes and to include a hashtag for Mondeléz’s Royal Baking Powder brand on such posts.

7.15 The Winner will be required to perform certain influencer services for Royal Baking Powder within a year from being determined as winner – which may include (inter alia) social media posts and an event appearance.

7.16 If you are selected as a Contender you will be required to sign a written Participation Agreement, which will, inter alia, incorporate the relevant terms and conditions contained herein. Should you fail to sign the aforementioned agreement within 24 (twenty-four) hours of it being provided to you, you will forfeit your opportunity to participate in the Competition and shall have no claim against the Stakeholders.

7.17 These terms and conditions will be construed, interpreted and enforced in accordance with the laws of the Republic of South Africa.

8. Reasons for disqualification

8.1 You may be disqualified, without compensation, as a Contender or as the Winner, should you: –

8.1.1 at any stage, supply untruthful, inaccurate or misleading personal details and/or information;

8.1.2 be in breach of any of the terms and conditions contained herein;

8.1.3 unreasonably refuse to participate in events or challenges that form part of this Competition and which will be announced by the Producers throughout the Competition;

8.1.4 be found, in the sole and unfettered discretion of the Producer, to be unfit during or prior to the Competition. Without derogating from the generality of the aforegoing, you may be considered unfit if you engage, or have engaged, in any activities that violate any law, offend against public morals, reflect negatively on the Programme and or the Stakeholders, compromise the success of the Programme and the Sponsors’ marketing activities related to the Programme, or embarrass the Stakeholders in any way.

9. Confidentiality and what you should do if the media approaches you

9.1 You agree not to disclose to any third party, without the prior written consent of the Producer, any information relating to the Programme/Competition, including, but not limited to, the application/selection process, your appearance in the Programme, behind the scenes happenings, any other Contenders, eliminations, the identity of finalists or the Winner, nor any other information which may come to your knowledge relating to the Stakeholders or their agents, or otherwise in connection with to the Programme, save for information which is already public knowledge through no fault of your own.

10. Indemnity

10.1 The Stakeholders shall not be held liable and you hereby indemnify and hold harmless the Stakeholders and their employees, directors, agents and representatives against any damage or loss of whatsoever nature arising from your Application or participation in the Competition and/or the Programme. This shall include, but not be limited to, damage arising as a result of travel, illness, injury, accident, death, loss of income, loss of profit, loss or theft of property whilst participating in the Competition.

10.2 You hereby indemnify the Stakeholders, their officers, agents, directors and employees against any costs or damages (including consequential damages and pure economic loss) that may be incurred by the Stakeholders as a result of claims or charges made against the Stakeholders (whether at the instance of the third party or yourself) for infringement of any right, whether the claim or action arises from delict or contract, or any infringement of whatsoever nature, arising out of or pursuant to the exercise by the Stakeholders or yourself of its/your rights or the fulfilment or breach by yourself of your obligations in terms of the Competition and such indemnity shall extend to the reasonable costs that may be incurred by the Stakeholders in defending any action instituted against it.

10.3 Except for any liability that cannot be excluded by law, the Stakeholders, their officers, agents, directors and employees exclude all liability including negligence for any loss or damage whether direct, indirect, special or consequential, any costs or damages arising in any way out of this Competition.

11. You warrant that:-

11.1 You understand and accept the terms and conditions contained herein and agree to be bound to these terms and conditions.

11.2 you have the legal capacity to send your application and to participate in the Programme and the Competition.
