THE TASTE MASTER SA WEEKLY VIEWER COMPETITION TERMS AND CONDITIONS 2023
Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1. INTRODUCTION
1.1 The Taste Master SA Competition (“Competition”) is being run by Cardova Trading (Pty) Ltd, Registration Number 2010/007686/07 (“Organiser/we/us/our”).
1.2 The Competition includes 12 (twelve) weekly prizes, ie. 1 (one) prize per week over a period of 12 (twelve) weeks.
1.3 Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of this Competition, agrees and accepts that the Competition rules as set out in these terms and conditions (“Rules”) is binding on him or her.
1.4 Copies of these Rules are available online at thetastemaster.co.za (“the Website”).
2. COMPETITION PERIOD
2.1 The Competition commences at 19:00 on 13 June 2023 and will close at 23:59 on 3 September 2023 (“Competition Period”). No entries received after the end of the Competition Period will be considered.
3. WHO CAN ENTER
3.1 In order to be eligible to enter the Competition you must:
3.1.1 be a legal, permanent resident of the Republic of South Africa (“RSA”);
3.1.2 be in possession of your valid identity document with a 13 (thirteen) digit identity number;
3.1.3 you must be at least 13 (thirteen) years of age or older. If younger than 18 (eighteen) years of age, you must be assisted by your parent or legal guardian who consents to you entering the Competition and your possible acceptance and/or use of any prize that may be awarded herein; and
3.1.4 be a natural person (e.g. not a company, close corporation, trust or other similar legal entity).
3.2 Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1 You can enter the Competition via Facebook and/or Instagram and/or Twitter (“Entry Platforms”).
4.2 The Competition will include 12 (twelve) weekly prizes. To be included in the prize entries, you must submit your entry within the entry period for that weekly Competition. The entry periods are as follows:

Prize 5: Opens Tuesday 11 July 2023 at 19:00 and closes Sunday 16 July 2023 at 23:59
Prize 6: Opens Tuesday 18 July 2023 at 19:00 and closes Sunday 23 July 2023 at 23:59
Prize 7: Opens Tuesday 25 July 2023 at 19:00 and closes Sunday 30 July 2023 at 23:59

4.3 To enter, create your own bake using a Royal Baking Powder product (“the Product”) based on the weekly competition theme, and take a picture of your bake with the Product (“your Picture”); and
4.3.1 reply to the Competition post on The Taste Master’s Facebook and/or Twitter pages with your Picture and a description of your bake, and
4.3.2 use #TheTasteMasterSA & #BakeMoreMemories on all entries, regardless of the Entry Platform.
4.3.3 when entering on Instagram post your Picture on your Instagram, include a description of your bake, use #TheTasteMasterSA & #BakeMoreMemories and tag @TasteMasterSA.
4.3.4 you may not superimpose or Photoshop the Royal Baking Powder product onto your photograph.
4.4 A new Competition post will be posted each week. To be included for the entries for that week, you must reply to the Competition post posted in that week. For the avoidance of any doubt, if you reply to a Competition post that was posted more than 1 week before your entry reply, your entry will not be included for that week.
4.6 You may enter the Competition as many times as you like, provided that each entry is a unique on the Entry Platform – i.e. you can post each unique entry once on each Entry Platform.
4.7 Once you meet the requirements set out in clause 3 above and this clause 4, you will automatically be entered into the Competition.
4.8 You are required to attend to the cost for your entry, including standard data/internet costs.
5. DETERMINATION OF PRIZE WINNERS
5.1 The Organisers will in their sole and unfettered discretion select 1 (one) weekly winner (Weekly Winner) within 72 (seventy-two) hours of the closing date for entries for each weekly competition, culminating in 12 (twelve) Weekly Winners in total.
5.2 Winners will be judged based on accuracy of the entry, creativity, originality, skill, the description given and inclusion of the product in the image.
6. PRIZES
6.1 Each Weekly Winner will receive a KitchenAid Artisan 4.8L Tilt-Head Stand Mixer to the total approximate value of R 13 990.00 (eleven thousand nine hundred and ninety rand) including VAT and a Parmalat product humper to the total approximate value of R 1 000.00 (one thousand rand).
6.2 The Competition prizes are not transferrable from the Winners to any other person and may not be exchanged for its cash value.
6.3 The Organiser reserves the right to substitute any prize herein, or any part thereof, with another item of equal commercial value at its discretion.
7. By submitting your Entry, you warrant/acknowledge/agree/submit that: –
7.1 You acknowledge that the Competition (e.g. Entries) may be televised as part and parcel of The Taste Master SA and/or as otherwise distributed by the Organisers. You hereby irrevocably assign to the Producers the entire copyright and all other rights of whatsoever nature in and to your participation in the Competition and The Taste Master SA, whether now in existence or arising in the future, including without limitation, the material submitted on your Entry, your performance and/or any comments ascribed to you, during your participation in the Competition and/or The Taste Master SA and any inclusion of your photographs, likeness, profile, name, voice, sound effect, caricature, literary, artistic and musical materials and the like for purposes of The Taste Master SA and/or any related publicity, research and marketing, which the Producers accept. You irrevocably authorise the Producers to use, edit, juxtapose, broadcast, re-broadcast, publish or communicate to the public your appearance/performance/participation and exploit and license others to use and exploit such contributions, in the whole or in part, by all means and by all media, manner and formats whether now known or hereafter invented throughout the world and in perpetuity without remuneration or royalties in connection with The Taste Master SA or on its own.
7.2 Without limiting the generality of the above, you specifically consent to your entry (including the images submitted therewith) being used on The Royal Baking Powder, KitchenAid and Parmalat online platforms.
7.3 Should the Organisers decide not to proceed with the Competition, for any reason whatsoever, the Organisers may in its sole discretion elect to terminate this Entry without any liability to you and without specifically notifying you.
8. CONFIRMATION OF WINNERS AND DELIVERY PRIZES
8.1 Winners of prizes will be contacted on the Entry Platform from which the entry was sent within 3 (three) days from determination of the winner to confirm the winner and to make arrangements for the delivery of the prize.
8.2 Winners will be required (within 3 (three) days of being requested to do so) to provide: –
8.2.1 further contact details, which may include an email address and telephone number,
8.2.2 a copy of the winner’s Identification Document (ID) (as required in accordance with Regulation 11 (6) (o) of the Consumer Protection Act 68 of 2008) and
8.2.3 a physical address (within RSA) for delivery of the prize (postal addresses not permitted).
8.3 Prizes will be delivered within 30 (thirty) days from confirmation of the Winner and receipt of all the required information detailed above.
8.4 If a Winner is not contactable within 48 (forty-eight) hours from the first attempt, the Winner will forfeit the prize without further notice and have no claim against the Organiser and the Organiser shall be entitled to select a different winner at its discretion. For the avoidance of doubt, the Organiser reserves the right to select a different Winner from shortlisted entries as contemplated in 5.2.2 and 5.3.2 above.
9. GENERAL TERMS
9.1 The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
9.2 The Organiser will interpret the Rules in their sole discretion.
9.3 Each person will only be eligible to win one prize for this Competition.
9.4 Any reference to the Organisers includes the directors, members, partners, agents or consultants of the Organisers, where the context allows for it.
9.5 The Organisers’ decision regarding any matter concerning the Competition and/or arising out of the Rules, including the determination of the Winners, is final and no correspondence will be entered into except where otherwise provided for in the Consumer Protection Act, 68 of 2008.
9.6 Where relevant, if a Winner does not accept a prize as required herein, if an entry is not valid for whatever reason, if a Winner has breached these terms and conditions, if a Winner renounces the prize or we deem such Winner to have renounced the prize, we reserve the right to declare the prize forfeited and/or to choose a new Winner.
9.7 Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the Organiser in terms of the Consumer Protection Act, 68 of 2008.
9.8 By entering this Competition, the entrant consents to the collection, processing and further processing of his or her personal information (including personal information contained in electronic communications) by us for the purposes of conducting this Competition and facilitating the entrant’s participation in the Competition. Except where prohibited by law or where objected to by the individual at any time, the Winner grants permission for us and those acting under our authority to use his or her name, and/or photographs, and/or voice for purposes of announcing the Winner and related advertising purposes, in any form of media and without additional compensation, notification or permission. A Winner may at any time decline an invitation to use, or object to the use of, his/her image in marketing material by directing such objection in writing to the Organiser’s representative who had initially made contact with the Winner for his/her further details, or by directing same to consumer services as provided in 9.16 below.
9.9 By submitting an entry to the Organiser, the entrant consents to and gives the Organiser a world-wide royalty free license to reproduce, modify, adapt and publish any content, images or comments included on the entry for the purposes of promoting the Organiser’s products and/or services.
9.10 By entering the Competition, the entrant unconditionally and irrevocably indemnifies and holds harmless the Organiser, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages (direct, consequential or otherwise), liability, demands, expenses, legal costs (on an attorney and own client basis), injuries howsoever arising out of, based upon, or in connection with (directly or indirectly) the entrant’s participation in the Competition and or the use of the prize. By accepting the prize, the winner accepts the prize at his/her own risk.
9.11 The organisers and its service providers, are not responsible for:
9.11.1 incorrect and inaccurate transcription of entry information;
9.11.2 technical malfunction;
9.11.3 lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network or computer equipment or software; and/or
9.11.4 the inability to access any services or any other error.
9.12 If required by the Minister of Trade and Industry, the National Consumer Commission or for whatever other reason, we will have the right to modify or terminate this Competition with immediate effect and without notice of such modification or termination. In such event, all entrants hereby waive any rights, which they may have against us and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against us.
9.13 We reserve the right to disqualify any entrant suspected of fraud or cheating including without limitations, through the manipulation of code or otherwise falsifying data.
9.14 We reserve the right to remove / delete any entries which are in our sole and unfettered discretion deemed to be obscene and or offensive.
9.15 The Competition is in no way sponsored, endorsed or administered by Facebook, Instagram or Twitter and any correspondence related to the Competition should be directed at us and not Facebook, Instagram or Twitter.
